These Terms of Service (“Terms”) govern your use of the Falcon Secure Storage website and the services we offer through it, including online payments and our text-messaging program. By accessing or using our website, you agree to these Terms. If you do not agree, please do not use the website.

This website is operated by Falcon Team Holdings LLC, DBA Falcon Secure Storage LLC (“Falcon,” “we,” “us,” or “our”), a self-storage facility located at 1903 Point Fosdick Dr., Gig Harbor, WA 98335.

You may use this website only for lawful purposes and in accordance with these Terms. You agree not to:

•       Use the website in any way that violates applicable law or regulation.

•       Attempt to gain unauthorized access to any part of the website, other accounts, or our systems.

•       Interfere with or disrupt the website or the servers and networks that support it.

•       Use the website to transmit any harmful code or unsolicited communications.

We may suspend or terminate your access to the website at any time if we believe you have violated these Terms.

These Terms govern your use of this website. They do not replace, modify, or supersede the separate written Rental Agreement (lease) you sign to rent a storage unit. The rental of storage space, charges, access, default, and lien and sale procedures are governed by that Rental Agreement and by Washington law, including the Self-Service Storage Facilities Act (RCW 19.150). If there is any conflict between these Terms and your Rental Agreement regarding your rental, the Rental Agreement controls.

We offer online payment through a third-party payment provider. By making a payment, you authorize the charge to your selected payment method and agree to the payment provider’s applicable terms. You are responsible for ensuring your payment information is accurate and current. Payments do not waive any past-due balance, late fees, or other charges owed under your Rental Agreement unless we expressly state otherwise.

If you provide your mobile number and opt in, you agree to the following terms for our text-messaging program. By providing your mobile number and opting in, you agree to receive text messages from Falcon Secure Storage at that number.

Program description

When you opt in, Falcon Secure Storage may send you text messages related to your storage account and our services, including:

•       Payment reminders and billing notices

•       Past-due, lien, and sale notices required under Washington law (RCW 19.150)

•       Gate and access information

•       Appointment, move-in, and move-out coordination

•       Facility updates and operational notices (for example, hours, weather, or maintenance)

•       Replies to questions you send us

Where you have separately consented to promotional messaging, we may also send occasional informational or promotional offers. Consent to receive promotional texts is not a condition of renting a unit or purchasing any service from us.

Message frequency

Message frequency varies depending on your account activity and our communications with you.

Cost

Message and data rates may apply. These charges come from your mobile carrier, not from Falcon. Check your mobile plan for details.

How to opt out

You can cancel the SMS service at any time by replying STOP to any message from us. After you send STOP, we will send one confirmation message and then stop sending texts to that number. You may also contact us using the details below to opt out.

Carriers

Mobile carriers are not liable for delayed or undelivered messages.

Your information

We handle the information you provide in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Your use of the website and our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.

The content on this website — including text, graphics, logos, and the Falcon Secure Storage name and marks — is owned by or licensed to Falcon and is protected by applicable law. You may not copy, reproduce, or use our content or marks without our prior written permission.

To the fullest extent permitted by law, Falcon and its owners, members, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the website. Nothing in these Terms limits any rights or remedies you may have under your Rental Agreement or under Washington law.

You agree to indemnify and hold harmless Falcon and its owners, members, and employees from any claims, losses, or expenses arising out of your misuse of the website or your violation of these Terms.

We may update these Terms from time to time. The “Effective date” above shows when they were last revised. Your continued use of the website after changes are posted means you accept the updated Terms.

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of the website will be brought in the state or federal courts located in Pierce County, Washington, and you consent to their jurisdiction.
